Off-Plan Escrow Across the UAE: Which Emirates Actually Protect You
Escrow is mandatory in four emirates and uncertain in others. What protects your off-plan payments, and where.

When you buy off-plan you hand money to a developer for something that does not exist. Escrow is the mechanism that stops that money being spent on anything else.
It is mandatory in some emirates and reportedly not in others. Most buyers never ask.
What escrow actually does
An escrow account is a project-specific trustee account held at an approved bank. Your payments go into it, and the developer can only draw funds against verified construction progress.
Three protections follow:
- 1Ring-fencing. Your money funds your project, not the developer's other obligations.
- 2Progress linkage. Funds release against milestones, so a stalled project stops drawing capital.
- 3Insolvency separation. Escrow funds sit outside the developer's general assets.
Escrow is not a completion guarantee. It does not protect against delay, specification changes or quality failures. It protects against your money disappearing.

How to verify escrow on your specific project
Do not accept a verbal assurance. Run these checks:
- [ ] Confirm the project is registered with the relevant emirate authority (DLD, ADREC, RAKIA RERA, ARRA, SRERD)
- [ ] Ask for the escrow or guarantee account number and the name of the trustee bank
- [ ] Verify independently with the authority that the account exists and is active
- [ ] Check the SPA names the escrow account as the destination for your payments
- [ ] Never transfer to a developer's general corporate account. If asked to, stop.
- [ ] Confirm Oqood or equivalent registration is available for your specific unit
- [ ] Check the published construction completion percentage where the authority publishes one
What to do where escrow is not mandatory
If you are buying off-plan in Sharjah, Umm Al Quwain or Fujairah, you are potentially outside the protection buyers take for granted elsewhere. Options:
What a DLD transaction record actually contains
Mortgage values are loan amounts and gifts may be nominal, so only the Sales rows feed any price figure on this site.
Buy ready instead. The simplest mitigation. If a property is complete, escrow is irrelevant.
Ask the developer to use escrow voluntarily. Some do. Get it in the SPA.
Weight developer covenant far more heavily. Without escrow, the developer's balance sheet is your only protection. That argues for large, established developers only.
Structure payments toward handover. The less capital deployed before completion, the less is at risk.
Take legal advice. For a purchase without escrow, an SPA review by a UAE-qualified property lawyer is not optional.
Why this is under-discussed
Escrow is dull, and it is a given in Dubai where most UAE property content is produced. Content written from a Dubai frame carries a Dubai assumption into markets where it does not hold.
If you are buying outside Dubai, Abu Dhabi, RAK or Ajman, ask the question explicitly.
